Terms of Service

These Terms of Service ("Terms") govern your use of the BrainTrail browser extension and the braintrail.app website (together, the "Service").
BrainTrail is built and operated by Enrik, an independent developer based in Greece, working as a sole proprietor. References to "we", "us", and "our" in these Terms refer to BrainTrail and its operator. You can reach us at hello@braintrail.app.
By using BrainTrail, you agree to these Terms. If you don't agree, please don't use the Service.
Who can use BrainTrail
You must be at least 16 years old to use the Service. By using BrainTrail, you confirm that you meet this requirement.
If you're using BrainTrail on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.
What BrainTrail does
The BrainTrail extension records information about your browsing activity locally on your device, helps you save notes from web pages, and lets you search through your past reading. Future Pro features will add cloud sync, AI-powered search, and other capabilities.
BrainTrail is provided "as is" — we work hard to make it useful and reliable, but we can't guarantee perfection. We may update, change, or discontinue features at any time, with reasonable notice for any significant changes that affect paying users.
Your account (when Pro launches)
If you create an account for BrainTrail Pro, you agree to:
- Provide accurate information
- Keep your password secure
- Notify us promptly of unauthorised access
- Take responsibility for activity on your account
You can delete your account at any time from the dashboard or by emailing us. When you delete your account, we'll permanently remove your data within 30 days (with some exceptions for backups and legal requirements).
Acceptable use
When using BrainTrail, you agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorised access to our systems or other users' data
- Reverse engineer, decompile, or copy the Service (except as permitted by law)
- Use the Service to harm, harass, or impersonate others
- Interfere with the Service's operation (e.g. by overwhelming our servers)
- Use the Service to violate anyone else's privacy or intellectual property rights
We reserve the right to suspend or terminate accounts that violate these rules.
Your content
Anything you create with BrainTrail — your trails, notes, tags, exports — belongs to you. We claim no ownership over your content.
For the free, local-only version of the extension, your content never leaves your device, so this is straightforward.
For Pro users (when launched), you grant us a limited licence to store, transmit, and process your content for the sole purpose of providing the Service to you (e.g. syncing it across your devices, running AI features you request). This licence ends when you delete your data or close your account.
Payment (for future Pro tier)
When BrainTrail Pro launches, paid plans will be billed in advance on a monthly or annual basis. Prices are listed on braintrail.app and may change with notice. Founding members who subscribe during the launch period will lock in their price for life as long as their subscription remains active.
Payments are processed by Stripe. Refunds are handled on a case-by-case basis — email us and we'll work it out.
You can cancel at any time. Cancellation takes effect at the end of your current billing period.
Intellectual property
The BrainTrail name, logo, design, and code are owned by the operator. You may not use any of these without written permission, except as needed to use the Service normally.
The BrainTrail extension code is closed-source. The website's source code may be made open-source at our discretion in the future.
Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
We don't guarantee that the Service will be uninterrupted, error-free, or secure. Things break. We'll do our best to fix them quickly, but we can't promise zero downtime.
Limitation of liability
To the maximum extent permitted by law, BrainTrail and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of (or inability to use) the Service.
Our total liability for any claim related to the Service will not exceed the greater of: (a) the amount you've paid us in the 12 months before the claim, or (b) €50.
Some jurisdictions don't allow these limitations, so they may not apply to you. Your statutory rights as a consumer are not affected.
Termination
You can stop using BrainTrail at any time by uninstalling the extension and (if you have an account) deleting it.
We may suspend or terminate your access to the Service if you violate these Terms, if we're required to by law, or if we discontinue the Service entirely. Where possible, we'll give you reasonable notice and a way to export your data.
Changes to these Terms
We may update these Terms as the Service evolves. When we do, we'll update the "Last updated" date at the top. For material changes affecting paying users, we'll notify you by email at least 30 days before the changes take effect.
If you continue using the Service after changes take effect, you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of Greece, without regard to conflict-of-law principles.
Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Athens, Greece, unless mandatory consumer protection laws in your country require otherwise.
If you're a consumer in the EU, you can also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Severability
If any part of these Terms is found to be unenforceable, the rest will remain in full effect.
